The mental health consultation platform "FundaTalk" (hereinafter referred to as "the Platform") respects your privacy rights. The collection, processing, and use of your personal data comply with the responsibilities under the Personal Data Protection Act of the Republic of China and relevant legal regulations. Before using the Platform, please read this General Usage Privacy Policy (hereinafter referred to as "this Policy") carefully to understand how the Platform collects, uses, and discloses your information to protect your rights. If you have any questions regarding the Platform's privacy policy, the following related notices, or matters related to personal data protection, you can contact the Platform, and we will respond as soon as possible. The Platform may modify this Privacy Policy at any time in response to changes in the social environment, legal regulations, and technological advancements. When you download and install the mobile application or use or continue to use the designated services of the Platform, and after confirming the privacy and membership-related terms, it indicates that you have read, understood, and agreed to accept all the contents of this Privacy Policy.

Article 1 Scope of this Policy

  1. This Policy applies to the collection, use, and protection of personal identification data when you use the various designated services provided by the Platform. When you use any designated service provided by the Platform and its mobile application or interact with it, it means that you agree that the Platform may collect, process, and use your personal data as described in this Privacy Policy.
  2. Regardless of the country or region in which you reside, you agree to authorize the Platform to collect, transmit, process, store, and use your personal data outside your country or region of residence in accordance with this Privacy Policy to provide you with designated services.
  3. This Policy does not apply to other websites, advertisements, or applications linked to the Platform. For the privacy policies and personal data protection notices of such websites, advertisements, or applications, please refer to each linked website.

Article 2 Methods of Collecting, Processing, Transmitting, Storing, and Using Personal Data

  1. The Platform will collect your personal data when you register an account. The purpose of using "personal data" is only for identity verification and matching in psychological counseling services, emergency contact, handling unforeseen circumstances in cases, and other matters related to the designated services of the Platform or services that may be derived in the future. When you agree to accept or request the Platform to assist you in case management (such as arranging appointments for psychological counseling), it means that you agree and authorize the Platform to collect, process, (internationally) transmit, store, and use the "personal data" you provide.
  2. The scope of "personal data" referred to in this Policy is as follows:
    • Identification: Personal identifiers (e.g., name, nickname, title, address, work address, telephone number, email address, photos, account applied for on the Platform, records of applying for inquiry services); financial identifiers (e.g., payment amounts, account numbers and names of financial institutions, or credit card numbers, security codes, expiration dates); government-issued identifiers (e.g., national ID number).
    • Characteristics: Personal descriptions (e.g., age, date of birth, gender, nationality); habits (e.g., smoking, drinking); personality (e.g., personality assessment opinions).
    • Family Situation: Family status (e.g., marital status); marital history (e.g., previous marriages or cohabitation, divorce or separation details); other social relationships (e.g., friends, colleagues, and other relationships outside the family).
    • Social Circumstances: Leisure activities and interests (e.g., hobbies, sports, and other interests); lifestyle (e.g., types of consumer goods used and service details); occupation; accidents or other incidents and related situations (e.g., nature of accidents, damages or injuries, parties involved, and witnesses).
    • Education, Examinations, Technical or Other Professional Qualifications: School records (e.g., universities, colleges, or other schools).
    • Employment Situation: Current employment situation (e.g., job title, work location); health and safety records (e.g., occupational diseases, safety incidents, accident records).
    • Unclassified Data: Correspondence, files, reports, or emails that cannot be categorized.
  3. The Platform does not process any data referred to in Article 6 of the Personal Data Protection Act.
  4. Your personal data mentioned above will be primarily received by Blossom Clinic of Psychosomatic Medicine (hereinafter referred to as "Blossom Clinic") and Joyworks Medical Technology Co., Ltd. (hereinafter referred to as "Joyworks"). We may also provide your personal data to related enterprises of Blossom Clinic and Joyworks, third parties entrusted by us to handle matters related to the Platform, and the psychologists/psychiatrists and their affiliated clinics you have scheduled through the Platform, to use or disclose your personal data as necessary for operational purposes within the scope of the aforementioned service purposes.
  5. The Platform may disclose your personal data for reasonable use purposes or in situations where the law stipulates that consent is not required. The Platform will do its utmost to minimize the disclosure of your personal data. If there is a need to entrust third parties to process or use your data, the Platform will appropriately supervise such third parties.
  6. With your consent or in the following situations, the Platform may provide data to other third parties:
    • When necessary for operational use within the scope of the specific purposes mentioned above (e.g., when you schedule/use designated services on the Platform and make payments, the financial information you agree to provide, including but not limited to account numbers and names of financial institutions, or credit card numbers, security codes, expiration dates, will be provided to specific third-party digital payment service providers).
    • Use beyond the specific purposes in accordance with the proviso of Article 20 of the Personal Data Protection Act.
    • Based on legal regulations or requests from judicial and other authorized agencies following legal procedures.
    • In emergency situations to protect the legitimate rights and interests of other members or third parties.
    • To maintain the normal operation of the member service system.

Article 3 Protection of Data

  1. The Platform has protected your personal data in accordance with relevant legal regulations and has taken appropriate technical and organizational information security measures, such as setting up firewalls, antivirus systems, and restricting personnel access to data.
  2. The Platform will do its best to protect your personal data but cannot guarantee that your personal data will not be illegally collected, processed, or used by third parties.

Article 4 Impact of Not Providing Personal Data

You are free to choose whether to provide the above personal data. However, if you do not agree to provide it, you will not be able to enjoy some or all of the designated services provided by the Platform.

Article 5 Specific Purposes of Collection

The Platform collects your personal data for use in the following situations: public health or infectious disease prevention; healthcare services; contracts, quasi-contracts, or other legal relationship matters; legitimate transactions of personal data; consumer and customer management and services; consumer protection; business and technical information; information services; information and database management; online shopping and other e-commerce services; advertising or commercial behavior management; investigation, statistics, and research analysis; other collections, processing, and use of personal data by natural persons based on legitimate purposes; other businesses operating in accordance with business registration items or organizational articles; other consulting and advisory services.

Article 6 Duration of Personal Data Use

The personal data you provide will be processed, used, or internationally transmitted and stored by the Platform during the period necessary for providing you with designated services, until you delete your account, or within the period permitted by other laws, or until you exercise relevant personal rights.

Article 7 Regions of Personal Data Use

The regions where the Platform's personal data hosts, related network server hosts, and related service marketing areas are located are the regions where your personal data is used.

Article 8 Your Rights to Personal Data

  1. According to Article 3 of the Personal Data Protection Act, unless restricted by other laws, you have the right to inquire or request to review, request a copy of, supplement or correct, stop collecting, processing, or using (including withdrawing consent, objecting to the Platform's continued processing of user data), and delete the personal data you provide.
  2. After the Platform confirms that the personal data belongs to you, if you wish to exercise the above rights or have other inquiries or complaints, you can contact the Platform or send your request to the Platform's email address (please refer to Article 11 "How to Contact Us") to exercise the following rights:
    • Inquire, review, supplement, or correct your personal data.
    • Delete or stop collecting, processing, or using your personal data.
    • Make a copy of your personal data.
    • Other matters the Platform can assist with.
  3. The Platform will process your exercise of personal rights. For inquiries or requests to review, or requests for copies, the Platform will reply within 15 days from the date of request. If necessary, it may be extended for another 15 days, and the Platform will notify you in writing of the reason for the extension. For requests to supplement or correct, requests to stop collecting, processing, or using, or requests to delete, the Platform will reply within 30 days from the date of request. If necessary, it may be extended for another 30 days, and the Platform will notify you in writing of the reason for the extension.

Article 9 Use of Cookies

  1. To facilitate your use, the Platform may use Cookie technology to provide services more suited to your personal needs. Using the Platform indicates that you agree to the use of Cookies to assist your browsing experience on the Platform. If you do not agree to the use of Cookies, you may change your browser settings yourself. Refusing to use Cookies may result in some functions of the Platform not working properly.
  2. To provide services more suited to your needs, the Platform will receive and record server values from your browser, including IP address and Cookies, when providing services related to optimizing the Platform.

Article 10 Impact on Rights and Interests Due to Accuracy of Personal Data

According to the nature of the designated services of the Platform, to ensure that related services can be smoothly provided, completed, or performed, if you are unwilling to provide the relevant personal data required by each service to the Platform and agree that the Platform may collect, process, use, and internationally transmit such personal data according to legal regulations, this Privacy Policy, and its related notices, the Platform will respect your decision. However, depending on the nature or conditions of each designated service, you may not be able to use the designated services, and the Platform reserves the right to agree to provide related designated services.

Article 11 Other Matters

  1. The Platform reserves the right to revise this Privacy Policy and related notices at any time and may publish them on the appropriate locations on the Platform or mobile applications after revision without individual notification. You can read the revised Privacy Policy and related notices on the Platform or mobile applications at any time.
  2. For any privacy disputes arising from your use of the Platform and mobile applications, you agree that the laws of the Republic of China shall govern. Unless otherwise stipulated by mandatory legal provisions, the Taiwan Taipei District Court shall be the court of first instance jurisdiction.
